A pending suit is weighing whether federal courts have authority to review novel "presidential permits" for scores of cross-border projects such as pipelines, refineries, sewage and other projects that the Bush administration is arguing are exempted from the usual environmental review requirements. The U.S. District Court for the District of Columbia is considering a suit challenging a permit for a major pipeline to carry tar sands from Canada to the Midwest, in response to State Department claims that environmentalists have no right to challenge it because the permit was issued under the "inherent constitutional authority of the President."
