Wastewater treatment officials are closely watching a landmark Clean Water Act (CWA) permit appeal that could set a national precedent requiring numeric pollutant limits in stormwater permits — instead of the less-prescriptive best management practices that are currently required in the permits, industry sources say. At issue is a petition for review submitted to EPA's Environmental Appeals Board last month, which calls for EPA Region III to modify a stormwater permit in Washington, DC, to include numeric discharge limits. The case, Friends of the Earth (FOE) and Defenders of Wildlife v. EPA Region III, could be the first to mandate that CWA National Pollutant Discharge Elimination System (NPDES) permits for stormwater discharges include numeric limits.
