The U.S. Forest Service doesn't have to fulfill an environmental group's Freedom of Information Act request for documents created by a third-party contractor related to a controversial land exchange in Colorado, the Tenth Circuit said Jan. 5. The documents, which deal with land involving a would-be residential ski area development opposed by environmentalists and known as the Village at Wolf Creek, weren't created, obtained, or controlled by the Forest Service and therefore weren't "agency records" subject to the FOIA.
