El Paso Natural Gas can pursue the federal government for the cost of cleaning up uranium contamination from mines on the Navajo Reservation, the District of Arizona ruled (EI Paso Nat. Gas Co. v. United States, 2017 BL 285617, D. Ariz., No. 14-cv-8165, 8/15/17). The federal government is liable under the Superfund law as an owner of contaminated reservation land held in trust for the Navajo Nation, the court said. Though the Navajo Nation has exclusive use and possession of reservation land, the United States holds title and "substantial powers over the land, including the power to enter, control alienation, and take," the court said.
