A New York advocacy group sued the Environmental Protection Agency March 25, seeking to compel an agency response to a petition objecting to a state permit for a landfill gas-to-energy facility (Concerned Citizens of Seneca Cry., Inc. v. McCarthy, W.D. N.Y., No. 6:16-cv-06196, 3/25/16). Concerned Citizens of Seneca County Inc. petitioned the EPA in September 2013 to object to a permit issued by the New York State Department of Environmental Conservation for the Seneca Energy Ⅱ LLC landfill gas-to-energy facility, but the group has not yet received a response, according to the complaint filed in the U.S. District Court for the Western District of New York. Under Section 505 of the Clean Air Act, the EPA is required to respond to the petition within 60 days.
