McCarthy, 11th Cir., 15-14035, 5/31/16). "They cannot do this," the government's brief, filed May 31 on behalf of the Environmental Protection Agency and the U.S. Army Corps of Engineers who jointly promulgated the rule, said. The DOJ brief urged the U.S. Court of Appeals for the Eleventh Circuit to dismiss the proceedings on jurisdic-tional grounds alone.
