Pennsylvania has the authority to use money from oil and gas leasing to supplement the state's general fund rather than leaving all of the money in a fund for environmental protection, a state court has ruled (Pa. Envtl. Def. Found, v. Corbett, Pa. Commw. Ct., No. 228 M.D. 2012, 1/7/15). The Pennsylvania Commonwealth Court Jan. 7 concluded that the Oil and Gas Lease Fund was created by legislation, not the state constitution, and the royalties paid into it could be controlled by law for purposes beyond environmental protection.
