The U.S. Court of Federal Claims awarded $44.4 million to System Fuels Inc. for the Energy Department's failure to carry out its contractual obligations to take possession of spent nuclear fuel and high-level radioactive waste from Grand Gulf Nuclear Station (System Fuels Inc. v. At issue in the case is a contract agreed to under the Nuclear Waste Policy Act of 1982, whereby the DOE was required to collect spent nuclear fuel from the plaintiffs by Jan. 31, 1998, in exchange for their paying into the Nuclear Waste Fund. The DOE didn't begin collecting spent fuel by that deadline because the intended disposal repository at Yucca Mountain in Nevada hadn't opened. The Obama administration halted work on the repository in 2010, and the DOE still hasn't begun collecting spent fuel and other radioactive waste from U.S. commercial nuclear plants (43 ER 207, 1/27/12).
