House Panel Advances Coal Ash Bill Allowing States Flexibility in Regulating Material

The House Energy and Commerce Committee advanced legislation April 15 that would give states more leeway on how to regulate coal ash and that would permanently bar the Environmental Protection Agency from regulating the material as a hazardous waste. The Coal Combustion Residuals Regulation Act (H.R. 1734), sponsored by Rep. David McKinley (R-W.Va.), passed on a 32-19 vote. Two Democrats-Reps. Mike Doyle (Pa.) and Kurt Schrader (Ore.)-backed the measure. Utilities, states and coal ash recyclers have voiced support for McKinley's bill, which would enable states to draft, implement and enforce their own permitting programs for coal ash management and disposal using minimum federal technical requirements set out in an EPA rule. Environmental advocates say the legislation would undermine human health and environmental protections.
