Environmental Protection Agency Administrator Gina McCarthy used her government-issued phones for "entirely proper" text message communications, and Congress should refrain from subjecting recipients of messages from McCarthy to investigation, the agency wrote in an April 23 response to a subpoena. Agency employees spent "hundreds" of hours compiling more than a thousands pages of billing records, message logs and texts in response to the late March subpoena from Rep. Lamar Smith (R-Texas), chairman of the House Science, Space and Technology Committee, according to a letter sent from EPA General Counsel Avi Garbow. Those records captured EPA employee text messages preserved as federal records, but did not include the contents of most of McCarthy's messages. They did, however, include a complete list of numbers of senders and recipients of McCarthy's texts, save for redactions made to protect medical privacy and the administrator's family information.
