Employees at a technical education program failed to show that contamination migrating from a Superfund site caused their personal injuries, a California appeals court has affirmed (Aguirre v. Fred R. Rippy Inc., 2015 BL 349870, Cal. Ct. App. 2d Dist., No. B255438, unpublished opinion 10/23/15). The earlier denial of the defendant's summary judgment motion didn't bar its later motion for summary judgment based on a different legal argument-lack of causation, the Court of Appeal of California, Second Appellate District, said in an unpublished opinion Oct. 23.
