Remet Corp. won't have to pay $550,000 in cleanup costs because a state environmental agency's demand letter triggered an indemnification clause in the company's purchase contract for property abutting an Erie Canal Superfund Site, New York's top court ruled Oct. 20 (Remet Corp. v. Estate of Pyne, 2015 BL 344517, N.Y., No. 129, 10/20/15). The letter from the New York Department of Environmental Conservation notified Remet it was potentially responsible for contamination at the state Super-fund site, and that was enough to satisfy a contract provision that indemnified only "required" environmental costs, the New York Court of Appeals said.
