GenOn Power Midwest, citing a "critically important and recurring question" of whether the Clean Air Act preempts state law nuisance claims that impose different emissions restrictions than the act, has asked the U.S. Supreme Court to review a decision that held that the act did not preempt the tort claims of property owners against the power company (GenOn Power Midwest L.P. v. Bell, U.S., No. 13-1013, petition filed 2/20/14). In a petition for certiorari filed Feb. 20, GenOn urged the U.S. Supreme Court to review the case, saying the issue was of "exceptional importance" to the regulated community and that the goal of the Clean Air Act to ensure some level of "uniformity, certainty, and predictability" with respect to air emissions standards will be "critically, perhaps fatally, undermined" by such state law tort claims.
