The Iowa Supreme Court ruled July 11 that an environmental activist can serve on the state's Environmental Protection Commission without violating the state's conflict-of-interest laws, thereby allowing that state's water anti-degradation policies for which she had voted to remain in effect (Iowa Farm Bureau Fed'n, v. Envtl. Prot. Comm'n, 2014 BL 192656 Iowa Sup.Ct, No. 12-0827, 7/11/14). The decision, written by Chief Justice Mark S. Cady, also held that the anti-degradation policies should be allowed to stand even though one of the commission members voting for their passage was no longer an Iowa elector at the time of the vote. EPC members are required to be Iowa electors.
