A Chinese-owned company blocked by President Barack Obama from developing a wind farm near a Navy base in Oregon on July 15 opened a crack in the secret process used to weigh the national security risks posed by foreign investors (Rails Corp. v. Comm. on Foreign Inv. in the U.S., D.C. Cir., No. 13-5315, 7/15/14). The U.S. Court of Appeals for the District of Columbia Circuit ruled that Rails Corp., owned by two Chinese nationals, must be allowed to challenge evidence the president drew on to decide the company must sell all assets and operations connected to the Oregon wind farm project.
