Guidance intended to help Environmental Protection Agency regional offices determine whether surface coal mine operators are meeting Clean Water Act requirements is not a final agency action subject to judicial review, a federal appeals court said July 11, upholding guidance issued by the EPA (Nat'l Mining Ass'n v. McCarthy, D.C. Cir., No. 12-5310, 7/11/14). The U.S. Court of Appeals for the District of Columbia Circuit also said that an EPA-U.S. Army Corps of Engineers memorandum intended to identify mining projects-with pending Clean Water Act Section 404 permit applications-that could be harmful to water bodies is within the agencies' authority and didn't violate any laws.
