A federal appeals court ruled in favor of conservation groups who sued over whether fish bypasses around hydropower dams on a Maine river are an adequate means for endangered salmon to migrate downstream (Friends of Menymeeting Bay v. Kennebee Hydro, LLC, 2014 BL 194572, 1st Cir., No. 13-1220, 7/14/14). In a July 14 majority opinion, Judge Norman H. Stahl of the U.S. Court of Appeals for the First Circuit overturned a ruling by the U.S. District Court for the District of Maine, saying it failed to consider all relevant evidence in a way that would be most favorable to the groups, Friends of the Menymeeting Bay and Environment Maine's Clean Water Act, in their claims and improperly granted summary judgment in favor of hydro-power dam operators.
