An oil company could be forced to permanently plug and abandon a well near the Everglades and be fined more than $100,000 if a Florida circuit court sides with the state's Department of Environmental Protection (Fla. Dep't of Envt'l Prot. v. Dan A. Hughes Co. LP, Fla. Cir. Ct., No. 112014-CA0016430001XX, 7/18/14). The Florida DEP on July 18 filed a lawsuit, as previously promised, against the Texas-based Dan A. Hughes Co. in the Circuit Court of Collier County, Fla. In the complaint, the DEP accuses the company of violating an April 8 consent order related to its Collier-Hogan well, including failure to submit a timely and acceptable spill prevention and cleanup plan and failure to retain independent third-party experts to assess potential groundwater contamination after an unauthorized acid treatment in December (45 ER 2131, 7/18/14).
