A landowner's agreement to allow lessees to transfer their liabilities to another party didn't clear the original lessees of liability for contamination predating the agreement, the U.S. District Court for the Northern District of Indiana has ruled (Anthony Wayne Corp. v. Eico Indus. Inc., 2014 BL 292632, N.D. Ind., No. 13-CV-1406, 10/17/14). The court Oct. 17 rejected the original lessees' argument that the liability only "occurred" when the landowner discovered the contamination several years after the new lessee took over the lease. "[T]he liability for the condition of the property 'occurred' when it happened, i.e., when the mess was created," the court said. Finding it unclear when the contamination occurred, the court declined to dismiss the claims on a motion for summary judgment. Anthony Wayne Corp. owns a property in Lo-gansport, Ind., which it has leased to a series of manufacturers.
