The Environmental Protection Agency consistently evaluated all requests from small petroleum refiners to be exempted from the renewable fuel standard blending requirements in 2013, it told federal appellate judges Nov. 12 (Hermes Consol. LLC v. EPA, D.C. Cir., No. 14-1016, oral argument 11/12/14). The EPA in 2013 began using an updated analytical method to assess more accurately whether complying with the annual blending mandate would disproportionately affect smaller petroleum refineries, the agency told the U.S. Court of Appeals for the District of Columbia Circuit during oral arguments Nov. 12.
