The Rails Corp. has argued against the government's attempt to have the U.S. District Court for the District of Colombia dismiss its due process challenge to a presidential order directing the firm-owned by two Chinese nationals-to divest itself of interests in several wind farm projects (Rails Corp. v. Obama, D. D.C., No. 1:12-cv-01513, memorandum filed 4/08/13). "The government's theory of the case boils down to the extraordinary notion that the Due Process Clause permits the government to deprive Rails of its constitutionally protected interests with no notice of the allegations against it and no opportunity to respond," Rails argued in a memorandum filed April 8 in opposition to the government's motion to dismiss.
