State and federal officials filed a joint motion June 11 seeking federal court approval of a settlement agreement under which AVX Corp. will pay $366.25 million plus interest to accelerate the cleanup of New Bedford Harbor (United States v. AVX Corp., D. Mass., No. 83-3882, motion filed 6/11/13). If approved by the U.S. District Court for the District of Massachusetts, the settlement would provide the Environmental Protection Agency and the state with most of the funds needed to clean up the harbor, which is contaminated with polychlorinated biphenyls and heavy metals, within a five- to seven-year period. The settlement is among the largest single-site cash settlements in the history of the superfund program, officials said.
