Challenges by tour engine manufacturers to Clean Air Act certificates of conformity issued to single manufacturer under invalidated interim rule authorizing certificates for 2012 model year noncon-forming engines with payment of penalty are moot, because: (1) EPA issued final rule with higher penalty provisions that applies to all engines introduced into commerce after date final rule was issued, (2) 2012 model year has ended and challenged certificates have all expired, and (3) manufacturers are unable to demonstrate more than speculative chance of obtaining redress for past economic injuries from single manufacturer marketing nonconforming engines while only paying lower penalties of interim rule.
