The owner of the Salem Harbor Power Station, one of oldest and most heavily polluting power plants in Massachusetts, has agreed not to use coal at any new generating units at the plant after the current facility shuts down in 2014 (Conservation Law Foundation v. Dominion Energy New England, D. Mass., No. 10-cv-11069, consent decree filed 2/3/12). The agreement by Dominion Energy New England not to repower or construct any generating unit on the site fueled by coal also contains language dismissing allegations brought by the Conservation Law Foundation and HealthLink that the company was in violation of the Clean Air Act. The consent decree, filed Feb. 3 in U.S. District Court for the District of Massachusetts, also requires Dominion to provide $275,000 for supplemental environmental projects designed to reduce air pollution in communities adjacent to the Salem Harbor Plant and reduce demand for electricity in the region.
