New Mexico's Environmental Improvement Board has repealed carbon dioxide cap-andtrade rules passed in 2010 by the same panel under the administration of former Gov. Bill Richardson (D). The board's unanimous 5-0 vote on Feb. 6, with two abstentions, to reverse itself repeals cap-and-trade rules issued by the EIB under the New Mexico Air Quality Control Act. The board is scheduled at its March meeting to vote on whether to repeal a separate rule that places a cap on carbon emissions. The repeal is seen as a victory for utilities and oil and gas developers, who fought the measure. But New Energy Economy, an environmental group that fought to maintain the cap-and-trade program, plans an appeal. A statement from the group called the repeal "pre-ordained."
