States in recent years are more often retaining cleanup authority over smaller and less complex waste sites, rather than turning them over to the federal government, and addressing those sites under alternatives to the superfund program, according to an Environmental Protection Agency official. That marks a departure from the way states handled those sites in the early years of the superfund program, established under the Comprehensive Environmental Response, Compensation, and Liability Act, Walter Mugdan, EPA Region 2 director of emergency and remedial response, told an American Law Institute/ American Bar Association (ALI-ABA) seminar Feb. 3.
