The Energy Department has the authority to take several actions immediately with respect to nuclear waste storage and fees, a consultant to a presidentially chartered commission told a meeting of utility regulators Feb. 7. First, the department could begin evaluating sites for a "monitored retrievable storage" facility for high-level spent fuel from commercial power plants and waste from defense activities, said Mike McBride, with the Van Ness Feldman PC law firm. McBride's law firm served as outside counsel to the Blue Ribbon Commission on America's Nuclear Future, which released its final recommendations Jan. 26 on how to manage high-level radioactive waste (43 ER 202, 1/27/12).
