The U.S. Forest Service failed to adequately weigh the impacts of a 2004 Sierra Nevada Forest Plan on individual fish species, a federal appeals court said Feb. 3 (Pacific Rivers Council v. U.S. Forest Service, 9th Cir., No. 08-17565, 2/3/12). In a 2-1 opinion, the U.S. Court of Appeals for the Ninth Circuit faulted the Forest Service for making significant changes to a 2001 plan for national forests in the Sierra Nevada without first taking "a hard look" at the amendments' consequences on fish, as required by the National Environmental Policy Act. The appeals court, however, rejected plaintiff Pacific Rivers Council's assertion that the Forest Service also did not sufficiently consider the 2004 Sierra Nevada Forest Plan's impacts on amphibians.
