The Environmental Protection Agency illegally exempted some ethanol producers from a requirement to demonstrate that their fuels had 20 percent fewer lifecycle greenhouse gas emissions than comparable petroleum fuels, a coalition of meat industry groups argued Feb. 13 before a federal appeals court (National Chicken Council v. EPA, D.C. Cir., No. 10-1107, oral argument 2/13/12).The Energy Independence and Security Act of 2007 only intended to exempt new gas- and biomass-fired ethanol plants built between 2008 and 2009 from the 20 percent lifecycle standard for those two years, according to Catherine Stetson, a partner at Hogan Lovells LLP representing the National Chicken Council, the National Meat Association, and the National Turkey Federation.
