The Environmental Protection Agency published a final rule Aug. 31 retaining the primary national ambient air quality standards for carbon monoxide (76 Fed. Reg. 54,294). EPA said the standards-9 parts per million measured over eight hours and 35 ppm measured hourly-are sufficient to protect public health. EPA said it will not set a secondary standard because carbon monoxide does not directly affect the environment. The rule requires states to monitor for the pollutant in areas near roads in heavily populated areas. Communities for a Better Environment and other environmental groups sued EPA in the U.S. District Court for the Northern District of California, alleging the agency failed to review the standards every five years as required by the Clean Air Act (Communities for a Better Environment v. EPA, N.D. Cal., No. 07-3678, order issued 5/5/08). EPA Administrator Lisa Jackson signed the rule Aug. 12, the court-ordered deadline, and the agency released it Aug. 15 (42 ER 1861, 8/19/11). The rule will be effective Oct. 31.
