The White House Office of Management and Budget is reviewing an Environmental Protection Agency final rule aimed at curbing air toxics emissions from power plants. The interagency review typically is the last step for a regulation before it is issued. EPA is under a court-ordered deadline to finalize the rule by Dec. 16. James Pew, an Earthjustice attorney representing environmental and health groups in their legal challenge to require EPA to issue the rule, told BNA Nov. 8 that sending the regulation to OMB "shows that they're on track to meet the Dec. 16 deadline." The White House received the final rule for interagency review Nov. 7, according to information posted on OMB's website.
