The Environmental Protection Agency has defended its pending "veto" action on a mountaintop mining permit by telling a federal court that the legal challenge from Arch Coal Inc. subsidiary Mingo Logan Coal Co. is premature, coming as it did before the EPA action has become final and before administrative remedies have been exhausted (Mingo Logan Coal Co. v. EPA, D.D.C., No. l:10-cv-00541, motion to dismiss filed 6/7/10).
