The cap on monetary damages that North Carolina can recover for natural gas or oil spills has been removed under legislation (S.B. 836) signed into law by Gov. Bev Perdue (D) Aug. 2.rnThe new law, assigned Session Law number 10-179 (S.L. 10-179), also specifies that federal liability limits established under the Oil Pollution Act of 1990 (33 U.S.C. Section 2701, et seq.) do not apply to discharges or pollution by oil within North Carolina's territorial jurisdiction. The measure also calls for additional planning and preparation for potential oil and natural gas spills from offshore facilities and the review of offshore production and exploration laws and regulations and response plans as a result of the BP oil spill in the Gulf of Mexico.
