A federal appeals court remanded the annual air quality standard for fine particulate matter to the Environmental Protection Agency Feb. 24, but upheld the agency's decision to revoke the annual standard for larger particles (American Farm Bureau Federation v. EPA, D.C. Cir., No. 06-1410, 2/24/09).rnThe unsigned opinion from the U.S. Court of Appeals for the District of Columbia Circuit ordered EPA to reconsider both the primary and secondary air quality standards for fine particulate matter. The court denied challenges from environmental groups to EPA's decision to revoke its annual primary standard for coarse particles.rnEPA "failed to explain adequately" why an annual fine particulate matter air quality standard of 15 micro-grams per cubic meter (μg/m~3) of air is sufficient to protect public health, according to the court.rnThe court also remanded EPA's secondary air quality standard-meant to protect public welfare-because it failed to adequately protect the public from fine particulate matter's effects on visibility. The secondary standard also was set at 15 μg/m~3.rnSources of particulate matter pollution include motor vehicle exhaust, power plant and factory emissions, and wood fires. Fine particulate matter can increase mortality rates through increased incidences of heart and lung disease.rn"Everybody outside of the Bush administration recognized the standard was inadequate," Earthjustice attorney Paul Cort, who argued on behalf of several environmental groups, told BNA.rnAttorneys for the industry petitioners could not be reached for comment.rn"The air standard for particulate matter is extremely important for the protection of public health," EPA spokeswoman Cathy Milbourn told BNA. "The new administration at EPA will be reviewing this decision carefully to ensure that the science and the law will be properly followed."
