The Environmental Protection Agency said it will forgo a procedure established in 2006 by Bush administration officials in setting the national ambient air quality standard for nitrogen dioxide because it is facing a tight deadline to make a preliminary decision whether to revise the standard.rnEPA said in a fact sheet posted on its website Feb. 13 that the agency will not issue an advance notice of proposed rulemaking for the primary nitrogen dioxide standard because it is under a June 26 deadline set out in a judicial consent decree to issue a proposed rule.rn"In light of that deadline and the agency's ongoing review of recent decisions and policies by the previous administration, EPA will focus its efforts on the upcoming proposal" rather than resubmitting an advance notice to the White House Office of Management and Budget, the fact sheet said.rnEPA established a new procedure for setting national ambient air quality standards (NAAQS) in 2006. That procedure included replacing staff recommendations on the level at which to set air quality standards with an advance notice of proposed rulemaking that suggests a standard and asks for public comment.rnAt the time, the new process was criticized by members of Congress and environmental groups for inviting political interference in the standard-setting process, which was designed in the Clean Air Act to be based on science (37 ER 2527, 12/15/06).rnEPA had said that using an advance notice instead of a staff recommendation was intended to streamline a process that never produced revisions to air quality standards within the five-year schedule established by the Clean Air Act.
