Environmental groups filed a federal lawsuit Oct. 7 challenging the U.S. Fish and Wildlife Service's critical habitat designation for the Peninsula bighorn sheep (Center for Biological Diversity v. U.S. Fish and Wildlife Service, S.D. Cal., No. 09cv2216, complaint filed 10/7/09).rn"The final rule fails to ensure that designated critical habitat is sufficient to conserve the species and promote recovery," the groups said in a complaint filed in U.S. District Court for the Southern District of California.rnIn April, the Fish and Wildlife Service issued a final rule reducing the critical habitat designation originally proposed in 2001 by 467,959 acres to 376,938 acres (40 ER 951, 4/24/09).rnThe complaint charges that the U.S. Fish and Wildlife Service violated Sections 3 and 4 of the Endangered Species Act by failing to issue a legally sufficient critical habitat designation for the sheep.
