A home builder in the Southeast has agreed to pay a $350,000 penalty and implement stormwater compliance programs to resolve allegations that it violated the Clean Water Act by failing to control stormwater runoff at residential construction sites in four states, the Environmental Protection Agency announced Nov. 9 (United States v. John Wie-land Homes, M.D. Tenn., No. 3:09-CV-1066, proposed consent decree filed 11/6/09). The penalty was levied against John Wieland Homes and Neighborhoods Inc. and John Wieland Homes and Neighborhoods of the Carolinas, both based in Smyrna, Ga. The companies build homes in primarily Georgia, North Carolina, South Carolina, and Tennessee.
