Notice announces a decision on a request for a determination of valid existing rights to use an existing U.S. Forest Service road as a coal mine access and haul road across federal lands within the Daniel Boone National Forest in Leslie County, Ky. The agency has determined that the applicant, Jag Energy LLC, possesses valid existing rights for the road, allowing them to obtain a state surface coal mining and reclamation permit to haul coal from a surface mine located on adjacent private lands. The action is effective Nov. 9, 2009.
