The EU Council Oct. 24 formally approved legislation to include aviation emissions in the European Union's Emission Trading Scheme (ETS), starting in 2012.rnApproval by the EU Council, which represents EU member states, formalized a compromise agreement between the Council and the European Parliament to require carriers of airlines landing in or departing from the European Union to trade emissions permits. The Parliament approved the legislation July 8 (39 ER 1385, 7/11/08).rnThe legislation sets an emissions cap for 2012 of 97 percent of average annual emissions between 2004 and 2006, beyond which airlines must buy additional carbon allowances. The cap will fall to 95 percent of annual emissions from 2004-2006 when the third phase of the EU emissions trading system begins in 2013.
