The main aim of this paper is to address the most important challenges associated with the BAT conclusions associated emissions-levels application. In the first place, there will be made a short presentation of the air emissions reduction framework. Secondly, the specific status of the BA T conclusions under the IED is presented. The third section discusses issues crucial to the BAT conclusions' application process, which are identified as follows: the wide discretion given to the competent authority, possibility of applying a derogation, and centralized and decentralized application control. The fourth section provides some final remarks and argues for a more balanced approach to the application of the BA T conclusions, which should attain not only environmental aims but should also reflect the aim to maintain the operation of industrial installations within the EU.
