Beginning with a brief overview of the judicial system for patent infringement in Germany, Japan and the US, the text offers a systematic comparative overview of the characteristic principles of patent enforcement proceedings in the US, Japan and Germany, where patent holders might seek for legal remedies in parallel proceedings. The book consists of a jurisdictional survey of significant features of patent infringement practice: forum-shopping; interplay of patent office invalidity proceedings and judicial forum of infringement determination, appeals, and claims of the patent holder and objections of the infringer; pre-procedural measures and procedural principles.
