An unpaid provider of necessary supplies to a ship is entitled, according to American maritime legislation, to a maritime lien over the vessel. The existence of other payment guarantees does not prevent the supplier from exercising his maritime lien, unless he has expressly waived his right to do so. According to American law, both the shipowner and the operator of a vessel can bring about the existence of a maritime lien over that vessel by ordering necessary supplies for it.
