When a shipowner discovers a technical problem with a ship that is under construction, it is under huge financial pressure. The shipowner's main worry is that if it rejects the ship until the remedial work is finished, the vessel may not meet its scheduled delivery date. If the ship is rejected, it runs the risk that the shipyard will issue a notice of default and, if no agreement is reached, cancel the ship. This is a major concern for the shipowner as the financial consequences of cancellation can be severe. Once the shipbuilding contract is cancelled, the shipyard can usually sell the ship at a private or public auction as it sees fit, after which it can keep the instalments and use the sale price to recover the full contract price, plus interest and all expenses relating to the sale. Usually if there is any excess over and above that amount, it will be paid to the shipowner.
