AS FURTHER appeals are unlikely, it appears the decision by a California court to force the US Environmental Protection Agency to regulate vessel discharges will prevail and enforcement will begin in September.rnLast week, an appeal court in San Francisco upheld a district judge's ruling that the EPA had exceeded its authority in granting ships and other craft a blanket exemption from the Clean Water Act. Several Washington DC maritime attorneys contacted by Fairplay doubt whether the EPA will appeal and even if it does, it is unlikely any appeal will forestall the mandated rulemaking.
