Lawyers are horrified that creeping unilateralism is threatening international legal rights. Countries are increasingly insisting that shipping follows their rules, even if that criminalises seafarers. Creeping unilateralism describes a trend in which states or supranational groups turn away from international bodies such as the IMO and promote their own rules. As the term suggests, it's growing fast. Dennis L Bryant, senior counsel at US law firm Holland & Knight, tells Fairplay: "The concept is that there is one body of law under which your ship can operate anywhere in the world. That is increasingly under attack." Chief bad guy at the moment for seafarers is the European Union, which is pushing its directive on ship-source pollution. Shipping figures are furious that the unilateralist measure would, if passed, criminalise accidents - especially because the directive appears unlikely to conform to international norms.
