HAD the us Coast Guard known of assistant captain Richard Smith's medical ills, he probably wouldn't have been at the helm of the Andrew J Barberi at all. But in fear of withheld details about his serious health conditions, his prescriptions and their side effects from his Coast Guard medical certificate. His doctor William Tursi has been charged with colluding in the deception. Smith's sins of omission came to a tragic end the afternoon of 15 October 2003, when he found himself alone in pilot-house of the Barberi on the approach to Staten Island's St George Terminal. Exhausted and suffering from chron-ic back pain, Smith" lapsed into a diminished state of consciousness" from a drug cocktail that mixed prescription medication Flomax and painkiller Tramadol with over- the-counter drugs Tylenol PM and an allergy medication containing dyphenhydramine. Out of control and sailing at near cruising speed, the ferry rammed into a maintenance pier, slicing the starboard passenger deck from bow to stern. Beyond the 11 dead, 71 passengers were injured.
