A charterer is only entitled to limit his liability for damage if he was acting as 'owner' when it occurred, a London Commercial judge has ruled. When the owner of CMA Djakarta sued the charterer, CMA CGM, for damage to the vessel and cargo during the charter period, CMA CGM could not limit its liability for damages under the 1976 Limitation Convention. The issues were whether a time charterer comes within the category of 'ship owner' for the purposes of the 1976 international Limitation Convention for limiting liability for marine claims. Even if so, was the charterer entitled to limit its liability against a claim by the actual owner for damage to the ship and cargo on the chartered voyage? The Commercial Court was asked to decide these questions on appeal from an arbitration award of damages and indemnification in favour of the owner of the CMA Djakarta.
