Houston port authority has been refused permission by the Federal Maritime Commission to charge its slow-paying or non-paying customers for any legal costs incurred to recover debts. Houston petitioned the FMC to change statutory rules to allow the port to incorporate the collection of litigation costs into its marine terminal schedules. The move would affect ship owners, export- ers, and shippers who had to pay demurrage fees, but not port users with a lease or individual contract with the port, according to the American Association of Port Authorities (AAPA). Houston had ar- gued that the introduction oi the Ocean Shipping Reform Act in 1998 provided a basis for the rule making, which would have rewritten shipping case law. Although the FMC decision maintains the status quo, the AAPA said it was "entirely possible" that the FMC might amend the rules if an individual case was presented.
