The owner of an Indian restaurant in Cheshire has been slapped with a community order and fined after a boy became ill from eating a curry which contained peanut. Layekul Islam, 60, is the owner of Balti Cottage Indian restaurant at Over Square in Winsford. In October, he pleaded guilty to three offences under Food Safety and Hygiene Regulations at Chester Magistrates Court. These included selling unsafe food from the restaurant after a young boy with a peanut allergy ate a takeaway meal from there containing the food. Other charges included the presence of cockroaches in the restaurant and failing to keep it clean. Islam was sentenced at Chester Crown Court on Thursday 14 November. Sentencing Islam, of Tabley Grove in Longsight, Manchester, Judge Simon Berkson said in September 2018, the restaurant was at the time being managed by a Mr Uddin, but that the defendant “remained responsible” for the business. Recapping the facts of the case, the Judge said on 2 September 2018, a family from Winsford ordered a takeaway from the Balti Cottage for a family night in. The family checked when ordering over the phone that there would be “no trace of peanut” in the dishes and asked for a chicken tikka masala for the boy, the Judge said. The takeaway was then picked up by the mother who “checked again” in person due to “concern for her son’s health” that there would be no traces of peanut in the dishes that was ordered, and was assured again that there was not, Judge Berkson told the court.
