摘要

The German Federal Court has emphasised the legal responsibility for judgements according criminal responsibility. Doubtlessly the final judgment about the amount of guilt lies in the judges' competence. But even in the field of personality disorders the judge still needs the help of the psychiatric expert to detect possible correlations between disorder and offence. Furthermore, statements according the impact of a personality disorder on the ability to act or to block an action must consider the individual competence and deficits, which can only be assessed by the expert witness.
